Moving from the Netherlands to Dubai requires a Dutch departure plan as well as a UAE arrival plan. The key issues are where the Belastingdienst considers you to live, deregistering from the BRP, the migration return (M-form), the protective assessment on a substantial interest or pension, the end of your Dutch social insurance, and what happens to your BV, home and family.
The Netherlands has no fixed day count for individual residence. Leaving is judged on the facts, so the quality of the break matters more than the date on your flight ticket.
Understand how the Netherlands decides residence
Under Dutch law, where you live is determined “according to the circumstances”. The Belastingdienst looks at the durable ties of a personal nature with the Netherlands: where your partner and children live, whether a home remains available to you, where you work, where your income comes from and where your social and economic life takes place. Details are published by the Belastingdienst.
Spending fewer than 183 days in the Netherlands is therefore not a departure strategy on its own. A family that stays behind in the Dutch home, or a role that keeps you working in the Netherlands every week, can keep you resident even if you hold a UAE visa.
Deregister and file the M-form
If you expect to live abroad for at least eight months within a year, you must deregister from the Personal Records Database (BRP) through your municipality, no earlier than five days before departure. Deregistration is required, but it does not by itself prove that you have left for tax purposes.
For the year of emigration you file the M-form, a migration return covering both your resident and your non-resident period. Keep your Dutch DigiD access and arrange how post from the Belastingdienst will reach you after you leave.
The protective assessment and other exit rules
On emigration, the Netherlands issues a protective assessment (conserverende aanslag) on the latent gain in a substantial interest of 5% or more in a company, and on pension and annuity rights that received Dutch tax relief. You do not pay immediately, but the tax becomes payable on a sale, certain distributions or a breach of the pension terms. For substantial interests, the assessment no longer expires for emigrations after 15 September 2015. Our guide to the Dutch exit tax and Box 3 covers the mechanics.
Dutch nationals also remain treated as Dutch residents for inheritance and gift tax for ten years after leaving. After emigration, Box 3 generally only applies to Dutch real estate you still own.
Check the treaty before relying on it
The Netherlands and the UAE have a double tax treaty. Before you rely on its residence tie-breaker, check how the treaty defines a UAE resident individual and whether that definition covers you as a non-Emirati. Some UAE treaties limit or condition individual residence, so obtain advice on the exact text rather than assuming that a UAE Tax Residency Certificate overrides Dutch domestic residence. Our UAE treaty guide explains why each agreement must be read individually.
Health insurance, AOW and benefits
Once you emigrate and are no longer covered by Dutch social insurance, your Dutch basic health insurance (zorgverzekering) ends and you must cancel it. Arrange UAE health insurance from your arrival date, as it is mandatory in Dubai.
You also stop building up AOW state pension, which accrues at 2% for every year you are insured. You can apply to the SVB for voluntary AOW/Anw insurance within one year of leaving. Benefits such as child benefit and allowances (toeslagen) generally stop when you move outside the EU, so notify the relevant bodies.
Separate your BV from your own move
A Dutch BV does not become a Dubai business because its director-shareholder relocates. If the board and real decisions remain in the Netherlands, the BV stays Dutch tax resident. If you start managing it from Dubai, new questions arise about its residence and about UAE substance.
Plan distributions, a possible sale and any transfer of activities before you leave, because they interact with the protective assessment. Compare Dubai company structures only after deciding which activities genuinely move. If you keep your Dutch company, read our guide to keeping a European company while living in Dubai.
Your Dutch home
Decide whether to sell, genuinely let or keep the property. A home that remains available to you, especially with family living there, is one of the strongest ties the Belastingdienst looks at. A let property continues to generate Dutch tax as non-resident Box 3 income, and your mortgage interest deduction ends once you emigrate.
Choose a UAE route that fits the household
Your route may involve employment, your own company, a Golden Visa, a remote work visa or family sponsorship. Compare the options in our overview of Dubai residence visas. Prepare passports, birth and marriage certificates and school records, and have them legalised: Dutch public documents usually need legalisation through the Dutch Ministry of Foreign Affairs and the UAE embassy, followed by attestation by the UAE Ministry of Foreign Affairs.
Build a departure and arrival calendar
| Before leaving the Netherlands | After arriving in Dubai |
|---|---|
| Review residence ties and the date of departure | Complete the residence visa and Emirates ID |
| Value your substantial interest and review pensions | Arrange health insurance, banking and housing |
| Deregister from the BRP, cancel Dutch health insurance, decide on voluntary AOW | Establish a genuine home and working routine |
| Legalise documents and notify banks, insurers and benefit agencies | Track travel days and keep a residency record |
Keep the departure and arrival evidence together in a clear Dubai residency record, so the chronology can be explained if the Belastingdienst asks questions later.
Returning to the Netherlands for visits
Visits are compatible with living in Dubai, but review them against the position you claim. Regular weeks in a former home, children still at a Dutch school or ongoing management of a Dutch business can matter more than the number of days alone.
The UAE tax residency tests should be assessed alongside the Dutch rules. Dubai Tax Resident guides cover the practical relocation, but the Dutch tax analysis must be based on your family, assets and actual conduct, so get a personal assessment from a qualified tax adviser. Frequently asked questions
No. Dutch law has no fixed day count; residence is judged on the circumstances and durable personal ties, such as where your partner and children live, whether a home stays available, where you work and where your economic life takes place. A family remaining in the Dutch home or weekly work in the Netherlands can keep you resident even with a UAE visa.
The M-form is the migration tax return you file for the year you emigrate, covering both your resident and non-resident periods in that year. You must also deregister from the BRP through your municipality, no earlier than five days before departure, if you will live abroad for at least eight months. Keep DigiD access and arrange how Belastingdienst post reaches you.

Only voluntarily. Once you emigrate and leave Dutch social insurance you stop building AOW state pension, which accrues at 2% for each insured year. You can apply to the SVB for voluntary AOW/Anw insurance within one year of leaving. Your Dutch basic health insurance also ends and must be cancelled, so arrange UAE health insurance from your arrival date.
